1. Respect for intellectual property
HubQuery respects the intellectual property rights of others and expects users of our platform to do the same. Our platform may contain user-generated content, including property listings, photos, descriptions, and profiles. We respond to notices of alleged copyright infringement in accordance with applicable law, including the Digital Millennium Copyright Act ("DMCA") where it applies.
2. Designated agent
If you believe that content on HubQuery infringes your copyright, please send a written notice to our designated copyright agent. Your notice should include:
- Your physical or electronic signature and identification of the copyrighted work you claim has been infringed (or a representative list if multiple works).
- Identification of the material that you claim is infringing and where it is located on the platform (e.g. URL or sufficient detail for us to find it).
- Your contact information: address, telephone number, and email.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Send DMCA notices to: [email protected] with the subject line "DMCA Takedown Request" or to the address we publish for our designated agent (e.g. in our Terms of Service or on this page). We may forward a copy of your notice to the user who posted the content and/or to third parties as required by law.
3. Counter-notice
If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notice that includes:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email, and a statement that you consent to the jurisdiction of the courts in the jurisdiction we specify (e.g. where HubQuery is based) and that you will accept service of process from the person who provided the original DMCA notice or their agent.
Send counter-notices to: [email protected] with the subject line "DMCA Counter-Notice". We may forward your counter-notice to the party who submitted the original notice. If we do not receive notice that a court action has been filed within a period required by applicable law, we may restore the removed content.
4. Repeat infringers
In appropriate circumstances, we will terminate the accounts of users who are repeat infringers of intellectual property rights. We may also remove content and suspend or terminate accounts in response to valid legal process or when we reasonably believe that content infringes third-party rights or violates our Terms of Service or Acceptable Use Policy.
5. Misuse of the process
Knowingly materially misrepresenting that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may expose you to liability. We may seek damages and other remedies from anyone who submits a notice or counter-notice in bad faith.
