Terms of Service
1. Acceptance of Terms
By accessing and using HubQuery, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.
Global scope: These Terms apply to users of HubQuery worldwide. Depending on your country of residence, additional terms or mandatory local laws may apply. Where local law requires different or additional provisions (including for consumer protection, dispute resolution, or data protection), those provisions shall take precedence to the extent of the conflict.
2. Account Security
You are responsible for maintaining the security and confidentiality of your HubQuery account. This includes:
- Password Protection: You must create a strong, unique password and keep it confidential. Do not share your password with anyone.
- Account Access: You are responsible for all activities that occur under your account, whether authorized by you or not.
- Immediate Notification: You must notify HubQuery immediately of any unauthorized use of your account, password, or any other breach of security.
- Two-Factor Authentication: We strongly recommend enabling two-factor authentication (2FA) for enhanced account security.
- Account Verification: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
HubQuery is not liable for any loss or damage arising from your failure to comply with these security obligations. We reserve the right to suspend or terminate accounts that show signs of compromise or suspicious activity.
3. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
Fraud and Deceptive Practices
- Creating fake or fraudulent accounts, listings, or reviews
- Using stolen credit cards, payment methods, or identity information
- Engaging in payment fraud, chargebacks, or payment disputes in bad faith
- Impersonating other users, agents, or HubQuery staff
- Providing false or misleading information about properties, prices, or availability
- Manipulating booking systems, pricing, or search results
- Creating multiple accounts to circumvent restrictions or policies
Spam and Abuse
- Sending unsolicited messages, emails, or communications to other users
- Posting duplicate listings or spam content
- Using automated systems (bots, scrapers) to access or interact with the platform
- Harvesting or collecting user information without consent
- Posting malicious code, viruses, or harmful software
- Interfering with or disrupting the platform's servers, networks, or services
- Attempting to gain unauthorized access to any part of the platform
Other Prohibited Activities
- Violating any applicable local, state, national, or international law or regulation
- Infringing upon the intellectual property rights of others
- Posting content that is defamatory, obscene, discriminatory, or hateful
- Engaging in any activity that could harm, disable, or impair the platform
- Using the platform for any illegal purpose or to facilitate illegal activities
- Circumventing or attempting to circumvent any security measures or access controls
Consequences: Violation of these prohibitions may result in immediate account suspension or termination, legal action, and reporting to relevant authorities. HubQuery reserves the right to investigate and take appropriate action against any suspected violations.
4. Intellectual Property
HubQuery's Intellectual Property
All content, features, and functionality of the HubQuery platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of HubQuery or its content suppliers and are protected by applicable local and international copyright, trademark, patent, trade secret, and other intellectual property laws.
- You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our platform without prior written consent
- The HubQuery name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HubQuery or its affiliates
- You may not use such marks without our prior written permission
User-Generated Content
By posting, uploading, or submitting content to HubQuery (including property listings, photos, reviews, and messages), you grant HubQuery a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to:
- Use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content
- Use your name, likeness, and any other information you provide in connection with the content
- Use the content for marketing, advertising, and promotional purposes
You represent and warrant that you own or have the necessary rights to grant the licenses described above and that your content does not violate any third-party rights or applicable laws.
5. Property Listings
Users agree to post only accurate, truthful, and legitimate property listings. Prohibited activities include:
- Posting fake, fraudulent, or misleading property information
- Listing properties that you do not have the right to sell or rent
- Including false pricing, location, or property details
- Spam, duplicate listings, or any form of abuse of the platform
HubQuery reserves the right to remove any listing that violates these terms without notice or refund.
5.1. Property Sales
Important: HubQuery is a marketing and lead generation platform for real estate transactions. We facilitate connections between buyers, sellers, and agents, but we are not a party to any property sale transaction.
By using HubQuery for property sales, you acknowledge and agree to the following:
- Platform Role: HubQuery acts solely as a marketing platform that connects potential buyers with property listings and real estate agents. We do not participate in, facilitate, or guarantee any property sale transactions.
- Title Transfer: Actual title transfer and property ownership transactions occur offline via legal deed and must be completed through licensed legal professionals, conveyancers, or solicitors in accordance with applicable property laws in your jurisdiction.
- Due Diligence: Buyers are solely responsible for conducting their own due diligence, including but not limited to:
- Verifying property title and ownership documents
- Conducting property inspections and surveys
- Reviewing all legal documents and encumbrances
- Verifying property boundaries and land use rights
- Confirming payment terms and transaction conditions
- No Transaction Guarantee: HubQuery does not guarantee that any property listing will result in a completed sale, nor do we guarantee the accuracy of property information, pricing, or availability.
- Agent Relationships: Any agreements, commissions, or arrangements between buyers, sellers, and agents are separate from HubQuery and are the sole responsibility of the parties involved.
Legal Advice: We strongly recommend that all parties involved in property sales consult with qualified legal professionals, real estate attorneys, or licensed conveyancers before entering into any property purchase agreement.
5.2. Tenant Screening and Long-Term Rentals
Important: HubQuery facilitates background checks and tenant screening services, but we do not guarantee tenant behavior, payment reliability, or property condition during long-term lease agreements.
For long-term rental properties (rental periods of 6 months or longer), the following terms apply:
- Screening Services: HubQuery may provide or facilitate background check services, identity verification, and credit checks through third-party providers (such as SmileID). However, these services are provided "as-is" and HubQuery does not guarantee the accuracy, completeness, or reliability of any screening information.
- No Tenant Behavior Guarantee: HubQuery does not guarantee tenant behavior, payment reliability, property maintenance, or compliance with lease terms. Landlords are solely responsible for:
- Conducting their own tenant screening and reference checks
- Verifying tenant employment and income
- Reviewing tenant rental history and references
- Setting appropriate lease terms and conditions
- Enforcing lease agreements and collecting rent
- Landlord Responsibilities: Landlords are solely responsible for managing their rental properties, including:
- Property maintenance and repairs
- Rent collection and payment processing
- Handling tenant disputes and complaints
- Compliance with local rental laws and regulations
- Eviction proceedings if necessary
- Platform Liability: HubQuery is not liable for any damages, losses, or disputes arising from tenant behavior, non-payment of rent, property damage, or any other issues related to long-term rental agreements.
- Third-Party Services: Any background check or screening services provided through third-party providers are subject to those providers' own terms and conditions. HubQuery is not responsible for the accuracy or availability of such services.
Recommendation: We strongly recommend that landlords conduct thorough tenant screening, verify all references independently, and consult with legal professionals when drafting lease agreements or handling tenant disputes.
5.3. HubMarket, HubFinder & Service Pros
HubQuery operates HubMarket (service provider marketplace), HubFinder (agents, agencies & developers directory), and Service Pros (repair and maintenance professionals). The following terms apply to these offerings:
- Platform Role: HubQuery acts solely as a marketing and lead-generation platform. We connect users with listed service providers, agents, agencies, developers, or Service Pros. We do not employ, endorse, or guarantee any listed party, nor are we a party to any agreement between users and listed parties.
- HubMarket: Service providers (e.g. mortgage lenders, builders, architects, contractors, movers) may list for free or via featured subscriptions. Contact details may be masked until a user opts to reveal them. We facilitate leads and analytics but do not verify the quality, legality, or performance of any service or transaction.
- HubFinder: HubFinder offers the same features and configuration as HubMarket (e.g. featured listings, masked contacts, analytics) for agents, agencies, and developers. We do not guarantee connections, conversions, or accuracy of profile information.
- Service Pros: Service Pros are repair and maintenance professionals (e.g. electricians, plumbers, painters). We facilitate discovery, quotes, and booking where applicable. We do not guarantee the quality, safety, or outcome of any service performed by a Service Pro.
- HubQuery Ads: We may offer advertising and promoted listing options (HubQuery Ads) to increase visibility of listings or profiles. Ad placement, targeting, and performance are subject to our advertising terms and platform configuration. We do not guarantee specific reach or conversion results.
- No Scraping: You may not scrape, harvest, or automate collection of contact information or other data from HubMarket, HubFinder, or Service Pros directories. Violation may result in termination and legal action.
Disclaimer: All interactions, payments, and agreements between users and listed parties (HubMarket, HubFinder, Service Pros) are solely between those parties. HubQuery is not liable for any loss, damage, or dispute arising from such interactions.
5.4. Verification Badges and Profile Information
HubQuery may display verification badges (e.g. verified agent, verified agency, verified professional) or similar indicators on user or business profiles. You acknowledge and agree that:
- No endorsement or guarantee: Verification badges indicate only that a user or business has completed our verification process (which may include identity or document checks). They do not constitute an endorsement, guarantee of quality, reliability, or conduct, or a guarantee that the verified party will perform any transaction or service.
- Accuracy: We do not guarantee the continued accuracy of verification status or that a verified user has not subsequently breached our policies or the law.
- Your responsibility: You are solely responsible for your own due diligence before entering into any transaction or agreement with any user or business on the platform, whether or not they display a verification badge.
6. Limitation of Liability
HubQuery acts as a platform connecting buyers, renters, and property agents. We do not guarantee the accuracy of listings, nor do we verify the identity or credentials of users. Users are responsible for conducting their own due diligence before entering into any transaction.
7. Dispute Resolution
Governing Law and Arbitration
Unless otherwise required by mandatory law in your jurisdiction (e.g. in the European Union, United Kingdom, or certain other countries where consumer law requires application of local law or courts), these Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be settled by binding arbitration in Lagos, Nigeria, in accordance with the Arbitration and Conciliation Act of Nigeria.
Where your country of residence mandates a different governing law or forum (including for consumer disputes), that law or forum shall apply to the extent required. For users in the EU/UK, you may also have the right to bring claims before the courts of your country of residence.
Arbitration Process
- Notice of Dispute: Either party may initiate arbitration by providing written notice to the other party describing the nature of the dispute
- Arbitrator Selection: The parties shall mutually agree on a single arbitrator. If no agreement is reached within 30 days, an arbitrator shall be appointed by the Lagos Court of Arbitration
- Arbitration Location: All arbitration proceedings shall be conducted in Lagos, Nigeria
- Governing Law: The arbitration shall be governed by the laws of the Federal Republic of Nigeria
- Arbitration Award: The arbitrator's decision shall be final and binding on both parties
Exceptions to Arbitration
The following disputes are not subject to arbitration and may be brought in court:
- Claims for injunctive or equitable relief
- Intellectual property disputes
- Small claims court matters (claims under ₦500,000)
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
8. Moderation and Content Review
All property listings are subject to review and moderation by HubQuery administrators. We reserve the right to approve, reject, or remove any listing at our sole discretion. Listings must comply with all applicable laws and regulations.
9. Changes to Terms
HubQuery reserves the right to revise these terms of service at any time. By continuing to use this website you are agreeing to be bound by the then current version. We will notify users of material changes via email or platform notification where practicable. The "Last updated" date at the top of this page indicates the latest revision.
10. Related Policies
Your use of HubQuery is also governed by our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Disclaimer. In the event of conflict between these Terms and a policy specific to a product (e.g. Host Agreement, Payment Terms), the product-specific policy shall prevail for that product.
